    Moshe smashed the tablets

    Hashem gave Moshe the tablets to give to the yidden. 

    So, Moshe was a messenger, a shaliach. A shomer chinam.  A shomer chinam is responsible for damages he himself caused to the guarded item. So Moshe was liable for the damage.

    Perhaps, this too, was the reason he was eventually disallowed to enter EY?

      There's a fascinating discussion on this in Parshas Ekev. Basically the Luchos were Mose personal property ( a gift from Hashem )

    Second replacements missing from the first

    The second luchos inferior to the first.

    The second Bais Hamigdash inferior to the first.

    Second marriages also inferior to the first?
