Confused...
I thought the teacher can't place a ban of ostracism on a person because if his honor (Ego is showing) . Posek 13 That only the beit din could do it for him?

Quesion on Chapter 5 - Contradiction in Terms by the Rambam
In the first part of Hallacha 3 the Rambam says that it a student sees a person comitting an aveirah, he may rebuke that person in fonr of his Reebi, ahf ahlpi shelo nasan lo Rabo reshus, - even if his Rebbi did not "give" hiim permission.
In the second part of hallacha 3, The Rambam says that for incidental matters, the student may only paskin if his Rebbi dies , or "ella im kain "notal" reshus meiRabbo - which the Oxford English translates as, "unless the student "receives" permission form his Rebbi.
The Rambam is very careful in his choice of words. The word "notal" is most frequently translated as "take" not "receive".
The Hebrew Dictionary confirms this.
Why did the Rambam swich from "nasan" to"notal'? I am sure that he is trying to tell us something.
In what situation may a student "take" (notal) reshus form his Rebbi?

What about a holy public construction project? A shul? A mikvah?
We all recall the Rebbe physically placing a large heavy cornerstone on the expansion of 770 even as some tried stop him from doing so.

Stand up for "older person". Does hat include women? I see in my translation that man is in parenthesis. So that excludes women?

We make two rows on either side of the av beis din in the Beis medresh
we also do the same for an ovel (mourner) after kevurah (burial).
Any connection? One is respect, the other comfort.

Burden . . . or Mitzvah?
A Talmid Chochom avoids walking where people usually go, in order to avoid putting a burden on people, which would cause them to have to stand up for him if they see him.
If one sees a Talmid Chochom, he is obligated to stand.
Why does the Rambam consider standing up for a Talmid Chochom as a burden if it’s a Mitazvah? Aderabah, I would think it’s a chance to give people an opportunity to do another Mitzvah, rather than a burden.

must a blind person stand also? Ironically there was such a person at a public local monsey shiur last Shavuous.
It seems to me to me that the Litvish crowd is mehudar to stand when their rosh yeshivas enter the room. But not so chassidim except for the Rebbe.
Notice lehavdil that there is a strong rule to stand when a judge enters a secular court room after the "All Rise"!

אין ראוי לת"ח שיטריח וכו' וחכמים היה מקיפין והולכין וכו'. וגרסינן ירושלמי בכורים פרק ג' הל' א' כמה צריך אדם לעמוד מפני זקן שמעון בר רבא בשם ר"י פעמים ביום ר"א אומר פעם אחת ביום לא כן תני רשב"א מניין לזקן שלא יטריח ת"ל זקן ויראת וכו' ע"ד דר"י ניחא ע"ד דר"א לא יקום כל עיקר ר"י בר אחא בשם ר"א דלא יחמי סייעתא דסבין ועבר קומיהן בגין דיקומון לון מן קמיה דלא יטריח לסבין, מלשון זה משמע דוקא לסבין שלא יטריח אבל לבחורים לית לן בה, ורבינו לא הביא הך חילוקא. וראיתי בספר צרור הכסף בליקוטים (דף קל"ג ע"ב) הביא לירושלמי הזה והקשה מהא דאיתא במדרש פ' בהעלותך על קרא דאספה לי שבעים איש וכו' אמר רב כשהייתי רואה סיעה של ב"א הייתי הולך בדרך אחרת שלא להטריח עליהם כשאמרתי דברי לפני ר"מ א"ל צריך אתה לעבור לזכותם ע"כ. וא"כ קשה על רבינו הך חילוקא. אמנם יראה מלשון רבינו כמ"ש עוד שם בס' הנ"ל לחלק דהירושלמי איירי בלא צריך לעבור שם משא"כ במעשה דר"א כוונתו היה לילך דרך שם וכיון שראה הסיעה עיקם הדרך וע"ז אמר שכה"ג צריך לעבור לזכותם להרגילם ביראת שמים, וכן מדוקדק בלשון רבינו וכ"מ בתלמודא דידן בקידושין (דף ל"ג:) דמקשה תלמודא על הא דאמר אין ת"ח רשאי לעמוד מפני רבו אלא שחרית וערבית מהא דאמר רשב"א מניין לזקן שלא יטריח ואי אמרת שחרית וערבית בלבד אמאי לא נטרח חיובא הוא ומשני כמה דאפשר ליה לא נטרח, הרי דתליא מלתא בדאפשר ליה, והנה לפ"מ דמשני בירושלמי דזקן לא יטריח מיירי דלא יחמו סייעתא דסבין ויעבור קומיהן ל"ק כלל קושית הגמרא דהא התוס' כתבו שם ד"ה אין דוקא תלמידים בבית רבם אבל תלמידים אחרים חייבים לעמוד לפניו בכל עת שעובר לפניהם וא"כ קשה דלמא בהכי מיירי הך דזקן ויראת

אך מסתפקנא אם אמרו לעלות קודם שגמר ברכת רצה ולא רצה ואח"כ קודם שהתחילו לקרוא כהנים ממש יצא לחוץ ולא היה בבהכ"נ בעת נשיאת כפים אם עובר או לא מי נימא כיון דכבר קראו אותו בעת עבודה דהוא התחלת חיובו לנשיאת כפים דהיינו שצריך אז מדינא לעקור רגליו לעלות לדוכן ולא רצה ממילא עקר העשה בזה גופא דהא קי"ל דשוב אינו רשאי לעלות וקרא דאמור להם כבר נתקיים דהא כבר קראו אותו לעלות וא"כ מה הועיל במה שיצא לחוץ בשעת נ"כ גופא או דילמא כיון דזה גופא דשוב אינו רשאי לעלות משמע דהוא אסמכתא בעלמא אקרא ומדאורייתא היה אח"כ ג"כ רשאי לעלות לדוכן אפשר דזמן חיובא הוא העיקר בשעה שהגיע לעצם נ"כ וכיון שהתחכם ויצא לחוץ מתחלה אף שקראו אותו בעת ברכת רצה מיקרי יציאתו זה מקמי דלימטי זמן חיובא ואינו עובר רק משום ויראת מאלהיך דאיתא בקידושין [דף ל"ג]

ואגב נתרץ מ"ש בזוהר יתרו זכור את יום השבת לקדשו לקבל לא תענה ברעך עד שקר כי המחלל שבת מעיד עדות שקר לבאר כל זה הוא כי יש ב' סוגים הנקראי' שבת א' שבת שמה כפשוטו נייחא ושביתה ב' ת"ח נק' שבת כנז' בזוהר משפטי' נשמתא דאיהי בת יחידא ואיהי בת זוג' דצדיק דאיהו שבת ומקודם לזה בצדיק דאיהו יום השבת לא תעבוד בו עבודת עבד וכו' יעו"ש. הרי יש ב' מיני שבת וכל א' שייך לחבירו והוא בן זוגו דשבת ובלא צדיק שעוסק בתורה אינו כלום כאמור וזהו כנסת ישראל יהי' בן זוגך שע"י בן זוגו יש לו תענוג בחיבור ויחוד משא"כ ממי שאינו בן זוגו היא מרה כנ"ל.
עוד י"ל דכ' המוהרשא' בפרק כ"כ בשם הרמב"ם לפי שאסורי שבת אינן ידועין להמון עם כגון הקשירה והטלטול והליכה ודיבור שלא לצורך וראוי לת"ח שהם הכהנים להודיען לע"ה וכו'. א"כ ב' מיני שבת שייכי' זה לזה כי רוב העולם שהם המוני עם אינן יודעים לשמור שבת כי אם ע"י הת"ח הנק' שבת ב' להורות הדרך לעם אש' ילכו בו
אך דכל זה אם נשמעו דברי הת"ח להורות לעם הדרך אשר ילכו בה משא"כ אם דברי הת"ח נמאסו כמ"ש ויראי חטא נמאסו אז ממילא גם שבת ראשון בפשוטו אינו נודע להעם וזה גרם חורבן הבית. כמ"ש בפרק כל כתבי אמ' אביי לא חרבה ירושלים אלא בשביל שחללו בה את השבת שנא' ומשבתותי העלימו עיניהם ואחל בתוכה א"ר יהודא לא חרבה ירושלים אלא בשביל שביזו בה ת"ח שנא' ויהי מלעיב' במלאכי אלדי' וכו'. וי"ל דמשמע דל"פ כמ"ש מוהרשא' דה"לל ר"י אומר וכו' וא"כ זה אמר לשון שלילא דלא חרבה רק עבור שבת וזה אומר עבור בזיון ת"ח ולדברינו א"ש שהכל ענין א'. וז"ש משבתותי העלימו משני שבתות הנ"ל העלימו לכך גרם חורבן. ובזה יובן אלמלא שמרו ישראל ב' שבתות לתקן קלקל החרבן מיד נגאלין וק"ל.

Halacha 14, subsections 17 and 18
"Whoever causes the blind to stumble" and "whoever keeps the public from fulfilling mitzvos".
As diplomatically and politically correct as I can be, and still ask the question: Tho many if not most of these forms of Cherem are not done today for various reasons, how are Torah observant yidden to regard those leaders of groups, especially the last 150 or so years, that indeed cause the blind to stumble and hinder the traditional observance of mitzvos.
A practical example: Do we give an aliyah in our shuls to a so called rabbi who advocates that which is forbidden by Torah?

The halachas in chapter 6 describe the honor due a chocham, etc.
Of course the full extent of many of these halachas do not apply today for various reasons. But the underlying rationale and practice still apply to the extent possible.
There are two problems, however.
Ths first occurs when there major theological disputes among sages, leaders and chochamim. One leader gave reasons for fge holocaust and pointed a finger at the nonobservant. Another disputed that saying we don't give reasons for such atrocity. Tge followers of each group took up the machines.
Are the followers of one group supposed to honor the chochom of the other with which their chocham vehemently disagrees? Do they follow any boycotts of a hechsher? Are the documents like hitting, geiris of the other group in such a case to be honored?
Today there are chesed type chochamim and gevurah type chochamim. Some gevurah types have banned some chesed types for creating a "new yiddushkei" of chesed. Do gevurah type followers go along with this? How should chesed type followers of their supposedly banned leader-chocham react?
Many other examples of intranicine (between brothers) machlokis. Same issues.
The second problem occurs when an established chocham has gone "OTD" in the eyes of other groups and even nonjews, but are still blindly followed by some. Unfortunately there are presumptive chochomim abd leaders who have committed heinous sexual or monetary crimes. Do we still honor them? What about the relationship between those outside this group and followers who follow nevertheless even as their chocham sit in jail.
